NEW YORK — A judge has given John Gotti grandson Carmine Agnello an ultimatum: go through with his oft-delayed kidney transplant to his mom Victoria Gotti by Monday, or report to prison to start his sentence.

Agnello, who was supposed to start serving his 15-month sentence for COVID fraud back on June 20, got a two-month reprieve so he could give his ailing mother a kidney in a procedure on Aug. 3.

But that date came and went with no kidney transplant because Agnello’s mother had a serious infection and was on a battery of antibiotics, according to his lawyer, Robert Beltrani. The attorney said he had “high hopes” the transplant would happen by Aug. 10.

On Thursday, U.S. District Court Judge Nusrat Choudhury set a ticking clock for the “Growing Up Gotti” star.

“1) Should the organ transplant procedure occur on or before August 10, 2026, Mr. Agnello shall self-surrender to the Bureau of Prisons by 2:00 pm on September 18, 2026,” the judge ruled. “2) Should the organ transplant procedure not occur on or before August 10, 2026, Mr. Agnello shall self-surrender to the Bureau of Prisons by August 10, 2026 at 2:00 pm.”

In March, Victoria Gotti wrote a lengthy letter begging the judge to spare Agnello prison time because of the pending kidney transplant, which her son’s lawyer at the time, Steven Metcalf, said she urgently needed. A month later, Agnello got a new lawyer who walked back that urgency after the transplant didn’t take place.
