Families can't sue over court spankings

BROWNSVILLE, Texas (UPI) -- Families trying to sue a Texas judge for allowing parents to spank children in his courtroom are not able to obtain monetary damages, a district judge decided.

State District Judge Abel Limas ruled Thursday a number of families in Los Fresnos, Texas, will not be able to seek damages in a civil suit against Justice of the Peace Gustavo "Gus" Garza, the Brownsville (Texas) Herald reported.

The decision stated that the Cameron County Pct. 6 Justice of the Peace is protected by judicial immunity.

The lawsuit was aiming to bring an end to the courtroom spankings and to recover unspecified monetary damages for embarrassment, physical pain and mental anguish.

Garza has said he does not order parents to spank children, but permits them to spank instead of owing fines.

"Any performance in his capacity as a judge is certainly protected by absolute immunity," Limas said.
