The court-appointed United Auto Workers monitor this week issued a cease-and-desist order against Region 2B Director Dave Green over an election rule violation.

The monitor, attorney Neil Barofsky of Jenner & Block LLP, found that leadership in the region, which covers Ohio and Indiana, pressured staff to remain neutral in the UAW's fall election of international leaders or to support Green's campaign, monitored staff supporting Green's opponent and threatened "consequences" for those who did, and specified career opportunities for those who supported Green's campaign. Green is running for reelection on the slate led by UAW President Shawn Fain, now called the "United UAW Team" after originally being introduced as the "Stand Up Slate."

"The Monitor considers this conduct among the most serious categories of Election Rules violations that the Monitor is charged with policing," Glen McGorty, partner at the Crowell & Moring law firm in New York who is a member of Barofsky's monitor team, wrote in a letter to Region 2B leaders. "When those in positions of authority within the Union pressure staff and members not to support the Candidate of their choice — reinforced by threats of 'consequences,' the tracking of dissenting staff, and communications that induce fear of adverse action — they use those positions of authority to interfere with the very rights the Election Rules and federal law guarantee."

The monitor ordered Region 2B leaders to cease and desist activity impeding UAW members' ability to support and oppose candidates, including intimidation or retaliation of any kind, the conditioning of professional opportunities, work assignments or other benefits on political support for Green’s campaign, and tracking staff's political support.

The Detroit News reached out to Green, his attorney and the UAW but didn't receive immediate responses. A representative for the Fain campaign declined to comment.

Rule 4-4 of the Official Rules for the 2026 Election states: “Any threats, intimidation, retaliation, penalty, discipline, or improper interference or reprisal of any kind, or any similar conduct is strictly prohibited, and reports of such violations shall be investigated by the Monitor.”

Seven complaints between June and August prompted the investigation, according to McGorty's letter, which emphasized that the order was a result of a "preliminary" inquiry that remains ongoing. The monitor could impose additional actions against Region 2B leaders pending results of the continuing investigation.
