Misunderstanding led to double-fatal road rage shooting, Florida police say

DAVIE, Fla. -- An air-conditioning technician who cut off another driver along Flamingo Road told a friend on the phone he was pulling over to apologize.

Instead of apologizing Friday, Keith Byrne, 41, was shot by the passenger in the BMW he cut off, Davie police said Wednesday.

Byrne returned fire, striking Andre Sinclair, 22. Byrne died at the shooting scene and Sinclair was taken to a hospital where he died two days later.

Both men had permits to carry their concealed guns, Davie Police Sgt. Mark Leone told reporters.

"There was a gun recovered from the scene in the street and there was a gun also in the white truck," he said.

The tragedy played out shortly after 2:15 p.m. Friday along Flamingo Road near Southwest Eighth Street.

 

Byrne was driving a white work truck and was speaking to a friend on his cellphone when he told the friend he accidentally cut off the BMW and was going to pull over and apologize at the traffic light, investigators said.

"(He) heard his friend Keith(Byrne) say, 'My bad,' in making an attempt to apologize," Leone said. "At that time over the phone he heard the gunshots and Mr. Byrne said, 'I think I've been shot,' started slurring his speech, and then the phone call was disconnected."

Sinclair was a passenger in the blue BMW his girlfriend was driving -- their toddler daughter was in the back seat.

According to police, Sinclair got out of the car displaying his gun and was heading for Byrne who was still inside his work truck.
