Army officer's shooting trial delayed

FAYETTEVILLE, N.C. (UPI) -- The trial of Sgt. William J. Kreutzer, who is accused of killing a fellow U.S. Army officer in North Carolina, will take place next year, a judge has ruled.

An Army judge ruled that Kreutzer's trial at North Carolina's Fort Bragg will move from Oct. 15 to January 2009 to free the legal site up for a high profile case from Iraq, the Fayetteville (N.C.) Observer said Wednesday.

Kreutzer has been accused of shooting at members of his own military unit on Oct. 27, 1995, killing Maj. Stephen Badger.

The sergeant has not denied the homicide allegations and was previously convicted in 1996, receiving a death sentence as his punishment. That conviction was overturned by an appellate court after it was found his defense lawyers had been ineffective during his initial trial, the Observer said.

The newspaper said the new trial taking Kreutzer's place at the one-courtroom Army site is that of Sgt. Alberto Martinez, who allegedly killed two officers in an Iraqi bombing.
