Case against DeLay may be dismissed
The six-member court had been asked to reconsider a decision reached last month that upheld the state's ban on corporate contributions but found the statute in place in 2002 didn't apply to checks, the Houston Chronicle reported Wednesday.
DeLay and two associates were accused of funneling $190,000 in corporate donations illegally to seven Texas congressional candidates in 2002.
DeLay's attorney, Dick DeGuerin, told the Chronicle he believes the case will be dismissed because the indictment charges the transactions were conducted with checks.
It wasn't until 2005 that the Texas Legislature added checks to the definition of "funds" in the state's money-laundering law.
If Tuesday's ruling by the Austin appeals court stands, DeGuerin says he will asked the trial judge hearing the DeLay case to dismiss the indictments.
DeLay, who has maintained the charges are political, was indicted in 2005 on charges of conspiracy to violate election laws and forced to resign his position as majority leader in the U.S. House of Representatives. He subsequently decided not to return to Congress.

Just because there was no law at the time on that technicality of using checks instead of cash to funnel money to Repugnicans running for seats, don't make it right. The spirit not the letter of the law, Delay knew that and he knew he was doin' wrong.

You need to get your facts right. Tom DeLay is charged with breaking a law that did not exist at the time he did it. They charged him retroactively. Last time I checked that is a violation of the constitution of the U.S. It is a political ploy by the Dimocrats to remove an effective man from congress and it worked. A favorite tatic of the Dims. If you can't win at the ballot box, take it to court. They tried the same thing on Kay Bailey Hutchinson and she won and so will Tom.
